Terms and Conditions


This Agreement is made between the owner of the property (“Owner”) and you and all the members of your holiday rental party (“Guest”) in respect of the property named overleaf (“Property”). By booking The Salt House through the website www.thesalthouse.pt you are entering an agreement with the owner of The Salt House, Tatiana Sena Bento.

When you submit a booking via our online reservation system you will receive a booking confirmation email. This email confirms your stay and the agreement between you and the Owner.

By clicking the online "accept" button you agree to all of the Booking Conditions and Terms listed here without exception. You must ensure that all members of your holiday party have read the terms and conditions contained herein and accept them in full. Completion of the booking form online will represent that all members of the party have agreed to these terms and conditions. Liability under this Agreement is joint and several between all members of the party.


Property conditions and details

The Salt House is able to receive 2 people. There is one queen size bed and day bed that can be used as a single bed. The property is to be occupied only by the persons specified on the booking form and for holiday purposes only.

The Guest is obliged to make full payment of the accommodation cost in order to complete the booking.

The Property has a minimal rental time of 2 nights.

You must be at least eighteen (18) years of age at the time of booking.

Smoking is not allowed inside the property. However it is allowed on the first floor balcony and on the roof terrace.

Pets are not accepted under any situation.

The property is not suitable for children under 6 years old.

The property is not suitable for people with limited mobility due to the existence of stairs.


Payment

All payments must be made through the website in order to complete your booking. Full payment is required with booking. Payment may be made by Debit Card or Credit Card.


Check in and Check out

The Guest and his/her party may arrive no earlier than 4pm on the arrival day and must depart no later than 11am on the departure day unless specifically advised or previously required otherwise. Failure to adhere to these times can result in additional rental charges plus a fee for delayed or hindered access to the property by cleaners and caretakers.


Guest Obligations

The Guest is responsible for leaving the property clean, tidy and in a similar condition as they found it. Any Loss, breakage or damage, however minor, must be reported immediately by the Guest to the Owner or his representative, who will make the appropriate charge for repair or replacement. The Guest will also be responsible for the cost of any excessive cleaning that may be required.

You agree not to exceed the number of people stipulated in the Property description on the website, not to allow other people on the Property and not to cause annoyance or become a nuisance or to cause excessive noise to occupants of adjoining premises.

You further agree not to use the Property for any commercial purpose including without limitation assigning or sub-letting the same or otherwise allowing anyone to occupy it that has not been notified as part of your party to the Owner.

The Guest must allow the Owner or his representative reasonable access to the property without notice to the Guest.


Liability

The Guests at The Salt House are insured against personal accidents. The insurance can be activated and will be taken forward with Insurance Company and abbey to its own regulations.

Save in respect of any death or personal injury claim caused by the negligence of the Property Owner, neither the Owner nor any of its representatives can accept liability for any damage, expense or loss of any nature whatsoever suffered by any person(s) from any cause whatsoever.

Save in respect of any death or personal injury claim caused by the negligence of the Property Owner or its representatives, any other liability of the Property Owner or its representatives under this Agreement shall be limited to the rental value of the relevant booking at the Property.

Neither the Property Owner nor its representatives shall be liable to you for any loss of profit, consequential loss or other indirect losses under the terms of this Agreement. Your vehicles and their accessories and contents are left entirely at your risk.

For the avoidance of doubt, the Owner and its representatives take every care to ensure that the accuracy of property descriptions and information contained on the website of The Salt House are correct at the time of publication. However in the event of any good faith error, neither the Owner nor its representatives can accept any liability. There are no warranties, conditions, guarantees or representations as to description merchantability or fitness for a particular purpose or other warranties, conditions, guarantees or representations whether express implied by statute or otherwise oral or in writing except as provided herein or such as cannot be excluded by law.

The use of any amenities, where offered, such as kitchen, barbeque etc is entirely at the user’s risk and no responsibility can be accepted by the Owner for any death or personal injury (save to the extent that such death or personal injury was caused by the negligence of the Owner or its representatives). No responsibility whatsoever is accepted by the Owner’s representatives, for any such death or personal injury (save to the extent that such death or personal injury was caused by the negligence of its representatives). No liability for any other loss or damage in connection with the use of such amenities is accepted.


Non Availability of Facilities / Amenities

The Owner reserves the right to alter or withdraw without prior notice facilities and/or amenities which have been advertised, where reasonably necessary due to repairs, maintenance or any other circumstances beyond their control.


Booking Alterations

Alterations to a booking can be made depending on availability and within a minimal number of days in advance.

If the Guest wishes to add extra days to the stay it may be done depending on availability and immediate payment of the extra days. If the Guest wishes to add days to the stay it should contact the Owner and require such alteration. The Owner will confirm availability and send and Invoice referent to the payment of extra days. The process is completed when the payment is done and the Guest receives a confirmation email with the new dates.

Persons added to a party booking at a later date must be advised to Owner in writing in advance of the holiday. Extra persons may incur an extra payment.

If the Guest wishes to remove days to the stay it may be done depending the number of days remaining before check in date. Dates can only be removed from the stay if requested up to 15 days before the check in dates (30 days for booking over 2 weeks). A minimum of stay of 2 days must still be obliged. If the Guest wishes to remove days to the stay they should contact the Owner and request such alteration. The Owner will send email confirmation and arrange a refund for the days in question. The process is completed when the refund is made and the Guest receives a confirmation email with the new dates.


Cancellation by Guest

If a Guest needs to cancel a booking he/she must inform the Owner immediately.

A full refund will be made if the cancellation is made up to 15 days in advance before the check in date (30 days for booking over 2 weeks). Cancellations made less than 15 before the check in date (30 days for booking over 2 weeks) are non-refundable.


Cancellation by Owner

If the Owner is affected by circumstances which are beyond their reasonable control (including without limitation flood, storm, fire, employment strikes, urgent unforeseen repairs required to Property, telecommunications access problems, destruction or damage of the Property or road blockages) then the Property Owner shall notify you immediately of the extent and nature thereof. In case of necessary cancellation the Owner will refund all monies paid.


Refunds

A full refund will be made if the cancellation by the Guest is made up to 15 days in advance before the check in date (30 days for booking over 2 weeks). Cancellations made less than 15 before the check in date (30 days for booking over 2 weeks) are non refundable.

We strongly recommend that you affect your own personal travel insurance in the country of your residence to cover all transport, travel and accommodation costs.

A full refund will be made if the cancellation is made by the Owner.


Complaints

Any complaint must be taken up immediately by the Guest with the Owner or his representative who must be afforded the opportunity to address the issue raised.


General

This Agreement and any document referred to in this Agreement constitutes the entire agreement, and supersedes any previous agreement, between the parties relating to the subject matter of this Agreement.

The failure to exercise or delay in exercising a right or remedy provided by this Agreement or by law does not constitute a waiver of the right or remedy or a waiver of other rights or remedies. No single or partial exercise of a right or remedy under this Agreement shall prevent any further exercise of the right or remedy of the exercise of any other right or remedy.

Except as expressly provided in this Agreement the rights and remedies contained in this Agreement are cumulative and not exclusive of any rights or remedies provided by law.

Nothing in this Agreement shall be construed as creating a partnership between the parties or as constituting either party as the agent of the other party (save as expressly set out in this Agreement) for any purpose whatsoever and neither party shall have the authority or power to bind the other party or to contract in the name of or create a liability against the other party in any way or for any purpose.

The Property Owner and its representative shall be entitled to perform any of the obligations undertaken by them and to exercise any of the rights granted to them under this Agreement.

You may not assign or transfer or purport to assign or transfer a right or obligation under this Agreement.

This Agreement is governed by, and shall be construed in accordance with, Portuguese law and the parties hereby submit to the non-exclusive jurisdiction of the Portuguese courts.
